Institutions designated as a place of detention, refuge and a remand home
Two Amendment Orders and a set of Amendment Rules which seek to declare a place of detention, a remand home and a place of refuge will be published in the Gazette today (May 4).
The Places of Detention (Juvenile Offenders) Appointment (Consolidation) (Amendment) Order 2001 seeks to appoint the Ma Tau Wai Girls' Home as a place of detention under the Juvenile Offenders Ordinance.
A place of detention under the Ordinance provides temporary custody for young persons and children aged 16 or below who are on remand pending police investigation or appearance before the Court or who are found guilty of an offence punishable with imprisonment.
The Remand Home (Amendment) Rules 2001 seeks to apply the Remand Home Rules (Cap 226 sub leg) to the remand section of the Ma Tau Wai Girls' Home. This is necessary as the Government proposes to locate the girls remand section of the Begonia Road Juvenile Home to the Ma Tau Wai Girls' Home, for efficiency reasons.
Another Amendment Order - the Protection of Children and Juveniles (Places of Refuge) (Amendment) Order 2001 - seeks to declare the Wing Lung Bank Golden Jubilee Sheltered Workshop and Hostel (WLBGJSW&H) as a place of refuge under the Protection of Children and Juveniles Ordinance (Cap 213).
This will enable the Unit for the Disabled in Ma Tau Wai Girls' Home, currently providing a refuge service for boys and girls with a disability, to be relocated to WLBGJSW&H.
Under the Protection of Children and Juveniles Ordinance, a place of refuge provides temporary care for children (aged under 14) and juveniles (aged between 14 and 18) in need of care or protection. These involve mainly children or juveniles who have been assaulted, ill-treated, sexually abused, or whose health, development or welfare have been neglected.
The Amendment Orders and the Amendment Rules will be tabled in the Legislative Council on May 9, 2001.
