Committee on Complaints against The Chinese Medicine Hospital
of Hong Kong (“Complaints Committee”)
Background
The Chinese Medicine Hospital of Hong Kong (“CMHHK”) is a hospital controlled by the Health Bureau (“HHB”). It is neither a public hospital managed by the Hospital Authority under the Hospital Authority Ordinance (Cap. 113) nor a private healthcare facility specified under the Private Healthcare Facilities Ordinance (Cap. 633).
Adopting a public-private partnership model, Hong Kong Baptist University (“HKBU”) and HKBU Chinese Medicine Hospital Company Limited respectively is the Contractor and Operator of the CMHHK pursuant to a Service Deed signed in January 2022. A permit to operate (“Permit”) has been issued to the Operator (“Permit holder”). Also, HHB has developed a dedicated control mechanism to exercise control over the operation of CMHHK. In accordance with the mechanism, HHB establishes the Complaints Committee which provides an alternative complaint channel against the Permit holder in the course of providing hospital service as controlled by HHB.
In relation to complaints received by the Complaints Committee, HHB will consider, among others, the Complaints Committee’s recommendations and the Permit holder’s implementation of improvement measures on hospital service as controlled by HHB, for the issuance, renewal, suspension and cancellation of the Permit.
